1. About these Terms
These Terms and Conditions (the “Terms”) govern your access to and use of the DiaCars website, user account, vehicle information reports, online shop, DiaCars Balance functionality and any other products or services made available by AVERLANE LTD through DiaCars (collectively, the “Services”).
By accessing or using the Services, creating an account, adding funds to your DiaCars Balance, or placing an order, you agree to these Terms. If you do not agree, you must not use the Services.
If you use the Services on behalf of a business or other legal entity, you confirm that you have authority to bind that entity to these Terms. Nothing in these Terms excludes or limits any rights that cannot lawfully be excluded or limited, including mandatory consumer rights.

AVERLANE LTD operates DiaCars as an online reseller and service provider, including the provision of vehicle information reports based on Vehicle Identification Numbers (VINs) and the sale of eligible automotive products and related services made available through the Website.
3. Eligibility and User Accounts
You must be at least 18 years old, or otherwise have full legal capacity to enter into a binding contract under the law applicable to you, to create and use a DiaCars account.
You are responsible for providing accurate and current account information, keeping your login credentials confidential, and all activity carried out through your account. You must notify us without undue delay if you believe your account or payment method has been used without authorisation.
We may ask you to verify your identity, ownership of a payment method, billing information, or other information where reasonably necessary for fraud prevention, security, compliance, refund processing, or investigation of a disputed transaction.
We may refuse registration, restrict account functionality, suspend an account, or close an account where reasonably necessary because of suspected fraud, unauthorised activity, abuse of the Services, chargebacks, legal or regulatory requirements, or a material breach of these Terms. Where reasonably possible and lawful, we will explain the reason for a material restriction.
4. DiaCars Services and Orders
The Services may include vehicle history and vehicle information reports, digital services, automotive products and accessories, account functionality, and other eligible products or services displayed on DiaCars from time to time.
Product and service descriptions, prices, availability, delivery information and any specific conditions shown on the relevant product page or at checkout form part of the contract for that order.
An order is subject to acceptance by DiaCars. We may refuse or cancel an order before fulfilment where, for example, a product is unavailable, there is an obvious pricing or description error, payment is not successfully authorised, or we reasonably suspect fraud or unauthorised use. If we cancel an order after receiving payment, we will return the amount due in accordance with these Terms and applicable law.
5. Vehicle Reports and Third-Party Data
DiaCars allows users to obtain vehicle information using a VIN. Vehicle report data may be sourced from third-party databases, public records, data aggregators and other external sources.
You are responsible for entering the correct VIN and checking the vehicle identity before ordering a report. A report generated for an incorrectly entered VIN will not normally be eligible for a refund merely because the VIN was entered incorrectly by the user, except where applicable law requires otherwise.
AVERLANE LTD does not create all underlying vehicle records and cannot independently verify every item of data supplied by third-party sources. The availability, coverage, accuracy, completeness and timeliness of information may therefore vary by vehicle, country, source and reporting period.
Vehicle reports are provided for informational purposes. They are not a substitute for a physical inspection, professional mechanical assessment, legal advice, ownership verification or other appropriate due diligence before purchasing, selling, financing or otherwise dealing with a vehicle.
You may use a report for your own lawful personal or internal business purposes. Unless we expressly agree otherwise in writing, you may not reproduce, resell, redistribute, scrape, systematically extract, publish or commercially exploit reports or underlying data.
6. Shop Products
Where DiaCars offers physical goods, including automotive accessories or related products, the product page will describe the main characteristics of the item and available delivery options.
Product images are illustrative. Minor differences in colour, packaging or appearance may occur, but this does not affect your statutory rights where goods are not as described, are not of satisfactory quality, or are not fit for a purpose made known to us where applicable.
Some products may be sourced or fulfilled with the assistance of third-party suppliers or logistics providers. This does not remove any responsibility that AVERLANE LTD has to you under applicable consumer law where AVERLANE LTD is the seller under your order.
7. Prices, Billing and Payment
Prices are shown in the currency displayed on the Website. Where applicable, the total price and any mandatory taxes, fees or charges will be displayed or explained before you are required to place and pay for an order. Delivery charges that depend on destination or delivery method will be displayed or calculated as part of the purchase process where applicable.
You may pay using the payment methods made available at checkout or by using available DiaCars Balance where that option is offered.
Card and other external payments are processed by third-party payment providers. DiaCars does not store your full payment card number or card security code on its own systems. Payment providers may provide us with limited transaction information, such as transaction status, payment method type, tokenised identifiers or the last digits of a card, where necessary to operate the Services and handle refunds or disputes.
You confirm that you are authorised to use the payment method submitted and that the information you provide is accurate. We may reject, delay or cancel a transaction where reasonably necessary to prevent fraud, comply with law, respond to a payment-provider instruction, or investigate unauthorised activity.
8. DiaCars Balance
8.1 Nature of the Balance
Registered users may be provided with an account balance displayed in euros (EUR), referred to in these Terms as “DiaCars Balance” and which may also be described in the user interface as a wallet or wallet balance.
DiaCars Balance records prepaid value available to the relevant user for eligible purchases through DiaCars. Adding funds to the Balance does not by itself constitute the purchase of a particular vehicle report, product or service.
DiaCars Balance is not a bank account, does not pay interest, and is not intended to be used as a savings facility. It may only be used for eligible purchases made through DiaCars.
8.2 Top-Ups
You may add funds to your DiaCars Balance (“Top Up”) using payment methods made available by DiaCars. Unless clearly stated otherwise before payment, the amount credited in EUR will correspond to the amount successfully received by DiaCars after any currency conversion applied by your card issuer or payment provider.
We may apply reasonable minimum or maximum Top Up amounts, account limits, transaction limits, or additional verification requirements for security, fraud-prevention, operational or compliance reasons. Any material limit that applies to a transaction will be shown or otherwise communicated where appropriate.
A Top Up is credited only after the relevant payment has been successfully authorised or confirmed. We may delay or reverse a credit where the underlying payment is cancelled, reversed, charged back, refunded, found to be unauthorised, or not actually received.
8.3 Permitted Use and Restrictions
DiaCars Balance may only be used by the account holder to pay for eligible products and services available through DiaCars.
- DiaCars Balance cannot be transferred to another DiaCars user or account.
- DiaCars Balance cannot be used to pay third-party merchants outside DiaCars.
- DiaCars Balance cannot be sold, assigned, pledged or exchanged between users.
- There is no automatic cash-out or withdrawal function for DiaCars Balance.
Paid DiaCars Balance does not expire solely because an account has been inactive, unless a different rule is introduced in the future in accordance with applicable law and is clearly notified before it applies. Promotional or bonus credit, if offered, may be subject to separate conditions disclosed when it is granted.
9. Refund Requests for DiaCars Balance
9.1 No Automatic Withdrawal
DiaCars Balance cannot be withdrawn simply by using a cash-out or withdrawal function. If you want us to return unused paid Balance, you must submit a refund request to DiaCars. A refund request is different from a transfer or withdrawal facility and will be reviewed in accordance with these Terms, the circumstances of the payment, fraud-prevention requirements, payment-provider rules and applicable law.
9.2 How to Request a Balance Refund
To request a refund of unused paid DiaCars Balance, contact info@diacars.com or use any refund request function made available in your account. Please provide sufficient information to identify the account and relevant Top Up transaction. We may ask for reasonable identity or payment-method verification before processing a refund.
We may approve, partially approve or decline a request where permitted by law. For example, a refund may be declined or reduced to the extent that the relevant Balance has already been spent, the underlying payment has been reversed or charged back, the amount represents promotional credit rather than paid funds, or we reasonably need to investigate suspected fraud, unauthorised use or abuse.
Nothing in this section allows us to refuse a refund where a refund is required by applicable law.
9.3 Refund Method
Where a refund of an unused Top Up is approved or required, we will normally return the eligible amount to the original external payment method used to fund the Balance. This helps protect both the user and DiaCars against fraud and misuse.
If the original payment method is unavailable or a refund to it is not technically possible, we may ask for additional verification and, where lawful and appropriate, agree an alternative refund method. We are not required to send a refund to an unrelated third party or to a payment method that cannot reasonably be linked to the original payer.
Refund processing times may depend on the payment provider, card issuer or bank. Where a statutory refund deadline applies, we will process the refund in accordance with that requirement.
9.4 Refunds of Purchases Paid from Balance
If an eligible purchase was paid using DiaCars Balance and that purchase is refunded, we may normally return the refunded amount to DiaCars Balance. Where applicable law requires a monetary refund by another method, or where we otherwise agree to do so, the refund may instead be returned to the relevant original external payment method or another agreed method after appropriate verification.
10. Refunds and Cancellation – Vehicle Reports and Other Digital Services
Vehicle reports are generated and supplied electronically, often immediately after an order is confirmed. If you ask us to begin generating or supplying digital content or services immediately, including during any statutory cancellation period, we may ask you to expressly request immediate performance and acknowledge that your cancellation rights may be lost or reduced once supply or performance begins or is completed, to the extent permitted by applicable law.
Once a vehicle report has been successfully generated and made available using the VIN supplied by you, we do not normally provide a refund simply because you changed your mind, no longer need the report, or expected different information to be present. This does not affect rights that cannot lawfully be excluded.
We will consider an appropriate refund, re-performance or other remedy where, for example, the report was not delivered, a technical failure prevented access, you were charged incorrectly, the wrong report was generated because of an error attributable to DiaCars, or applicable law gives you a remedy.

11. Cancellation, Returns and Refunds – Physical Goods
If you are a consumer purchasing physical goods online, you may have a statutory right to cancel an eligible distance contract within the applicable cancellation period, including a right to change your mind in circumstances provided by law. Certain goods may be excluded from cancellation rights by law.
Where a statutory cancellation right applies, you must inform us that you wish to cancel within the applicable period and return the goods in accordance with the instructions we provide. You may be responsible for the direct cost of return where the law permits this and we informed you accordingly before purchase.
You remain entitled to the remedies provided by applicable law where goods are faulty, damaged, not as described, or otherwise do not meet mandatory legal requirements. Nothing in these Terms replaces or reduces those rights.

12. Chargebacks, Reversals and Unauthorised Payments
If a Top Up or other payment is reversed, charged back, cancelled, refunded by the payment provider, or determined to have been unauthorised after the corresponding DiaCars Balance has already been credited or spent, we may reverse the corresponding Balance entry or deduct the affected amount from your account.
If there is insufficient Balance to cover the reversal, your account may show an outstanding amount and we may restrict further purchases, Top Ups or other account functionality until the issue is resolved. We will not impose charges that are disproportionate to the actual loss or costs caused by the event.
Nothing in these Terms prevents you from contacting your card issuer or payment provider about a genuinely unauthorised or disputed transaction, and nothing restricts any chargeback or statutory rights available to you. We encourage you to contact DiaCars first where the issue can reasonably be resolved directly.
13. Delivery and Availability
Digital reports and other digital products are normally made available electronically through your account, on-screen, by email, or by another method described at checkout.
For physical goods, estimated delivery information will be shown or communicated during the purchase process. Delivery estimates are not guaranteed where delays are caused by events outside our reasonable control, but this does not affect any delivery rights you have under applicable law.
If a product or service becomes unavailable after payment, we may offer a replacement, re-performance, Balance credit or refund as appropriate, subject to your statutory rights and the circumstances of the order.
14. User Responsibilities and Prohibited Uses
You must use DiaCars lawfully and must not misuse the Website, Services, vehicle data, account functionality or payment features.
You must not:
- use DiaCars for fraud, money laundering, sanctions evasion, payment abuse, unauthorised transactions or any other unlawful activity;
- use a payment method without the permission of the lawful holder;
- create or operate accounts using false, misleading or stolen information;
- attempt to use Top Ups, refunds, chargebacks or DiaCars Balance as a means of transferring value between unrelated persons;
- circumvent account, payment, fraud-prevention, technical or security controls;
- introduce malicious code, interfere with the Website, scrape the Services in an unauthorised manner, or attempt to gain unauthorised access to systems or data;
- infringe intellectual property, privacy or other rights of AVERLANE LTD or any third party; or
- reproduce, redistribute or commercially exploit vehicle reports or data except where expressly authorised in writing.
15. Third-Party Services and External Sources
DiaCars may rely on or integrate with third-party services, including vehicle-data providers, payment providers, hosting providers, fulfilment providers, logistics providers and other technology or service partners.
Where a third party provides a separate service directly to you, its own terms and privacy information may also apply. We are not responsible for independent third-party websites or services that are outside our control, but this does not exclude any responsibility AVERLANE LTD has for its own obligations under your contract with us.
16. Intellectual Property
The DiaCars Website, branding, layout, text, graphics, software and other content owned by AVERLANE LTD are protected by applicable intellectual property laws. Vehicle data and third-party materials may be owned by or licensed from their respective providers.
Except for the limited right to use the Services in accordance with these Terms, no intellectual property rights are transferred to you. You must not copy, modify, distribute, reverse engineer or commercially exploit protected content except where permitted by law or expressly authorised by us.
17. Website Availability, Security and Changes to the Services
We aim to keep the Website and Services available and secure, but we do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, security incidents, technical faults or events outside our reasonable control may temporarily affect availability.
We may make reasonable changes to the Website or Services for security, legal, technical, operational or product-development reasons. We will not use a change to deprive you of a material right relating to a completed purchase where doing so would be unlawful or unfair.
18. Suspension, Closure and Remaining Balance
You may stop using DiaCars at any time. If you wish to close an account that contains unused paid DiaCars Balance, you should submit a refund request before or as part of the closure request.
If we close an account for reasons unrelated to fraud, payment abuse or a serious breach by the user, we will deal fairly with any eligible unused paid Balance and will arrange a refund where required by law or otherwise appropriate under these Terms.
Where an account is restricted or closed because of suspected fraud, unauthorised payments, chargebacks, sanctions, legal requirements or other serious misuse, we may temporarily withhold refund processing while we carry out reasonable verification or investigation, but only to the extent permitted by law.
19. Privacy and Personal Data
We process personal data in accordance with the DiaCars Privacy Policy and applicable data protection law. This may include account information, contact details, order information, VINs, Top Up and Balance transaction records, payment-related identifiers, refund information, fraud-prevention information and communications with support.
Payment providers and other service providers may process personal data where necessary to provide their services, process transactions, prevent fraud, fulfil orders or comply with law. Please review the DiaCars Privacy Policy for further information.
20. Warranties and Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or fraudulent misrepresentation, or any mandatory liability or consumer remedy that cannot legally be excluded.
If you are a consumer, AVERLANE LTD is responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable when the contract was made, or for business losses where you use the Services wholly or mainly for commercial purposes.
Because vehicle report information depends on external data sources, we do not promise that every report will contain every possible event or record concerning a vehicle. Subject to your statutory rights, we are not responsible for inaccuracies, omissions or delays in third-party records that we could not reasonably detect or control.
You remain responsible for your own purchasing, selling and vehicle-related decisions. You should obtain an independent inspection and appropriate professional advice where the condition, legal status, value or safety of a vehicle is important to your decision.
21. Complaints and Disputes
If you have a complaint about a report, product, payment, Top Up, Balance or refund, please contact info@diacars.com. We will review the matter and may ask you for information reasonably needed to investigate it.
These Terms do not restrict any right you may have to contact your payment provider, card issuer, consumer-protection authority, court or other competent dispute-resolution body.
22. Governing Law and Jurisdiction
These Terms and contracts made through DiaCars are governed by the laws of England and Wales, except to the extent that mandatory law applicable to you provides otherwise.
The courts of England and Wales will have jurisdiction over disputes, but if you are a consumer living in another part of the United Kingdom or another country, you may also have the right to bring or defend proceedings in the courts of your place of residence where mandatory consumer law allows this.
23. Changes to these Terms
We may update these Terms where reasonably necessary because of changes to the Services, law, regulatory requirements, payment-provider requirements, security risks or business operations.
The current version will be published on the Website with its effective date. Where a change is material and affects an ongoing account relationship, we will provide reasonable notice where required or appropriate. Changes will not remove statutory rights or retrospectively alter a completed transaction where doing so would be unlawful.
24. Severability, Waiver and Assignment
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
If we do not enforce a provision immediately, this does not mean that we waive our right to enforce it later.
You may not transfer your account or assign your rights or obligations under these Terms to another person without our consent. We may transfer our rights or obligations as part of a reorganisation, merger, sale of business or similar transaction, provided that doing so does not reduce any mandatory rights you have.
